LoanHunters is an intermediary service that connects consumers with registered credit providers. We do not provide credit, make lending decisions, or determine credit terms. All credit applications are subject to the credit provider's own terms, conditions, and approval criteria.

1. Definitions and Interpretation

In these Terms and Conditions, unless the context indicates otherwise:

  • "LoanHunters", "we", "us", or "our" refers to the credit intermediary service operating the website loanhunters.co.za
  • "You", "your", or "consumer" refers to any person using our website or services
  • "Credit Provider" refers to any registered financial institution that provides credit products
  • "Partner Lenders" refers to credit providers we work with and connect consumers to
  • "NCR" refers to the National Credit Regulator established under the National Credit Act
  • "NCA" refers to the National Credit Act, 2005 (Act No. 34 of 2005)
  • "POPIA" refers to the Protection of Personal Information Act, 2013 (Act No. 4 of 2013)
  • "Services" refers to our intermediary and connection services between consumers and credit providers

2. Agreement to Terms

By accessing or using the LoanHunters website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these terms, you must immediately cease using our services.

These Terms and Conditions constitute a legally binding agreement between you and LoanHunters. Your continued use of our services constitutes ongoing acceptance of these terms as they may be amended from time to time.

3. Nature of Our Services

3.1 Intermediary Role

LoanHunters operates strictly as an intermediary service that facilitates connections between consumers seeking credit and registered credit providers. We emphasize that:

  • We are NOT a credit provider and do not provide credit ourselves
  • We do not make lending decisions or determine whether your application will be approved
  • We do not set interest rates, fees, loan amounts, or repayment terms
  • We do not guarantee loan approval or credit availability
  • We act solely as a channel for you to access credit providers
  • All credit decisions are made independently by credit providers based on their own criteria

3.2 Our Service Offering

Our services include:

  • Providing an online platform to submit loan applications
  • Collecting your information and forwarding it to appropriate credit providers
  • Facilitating communication between you and credit providers
  • Maintaining a database of applicants for potential future matching with credit providers
  • Providing general information about credit products (for informational purposes only)

3.3 Partner Credit Providers

All credit providers in our network are registered with the National Credit Regulator (NCR) in terms of the National Credit Act. You can verify any credit provider's registration status at www.ncr.org.za. Each credit provider operates independently and has their own:

  • Terms and conditions
  • Affordability assessment criteria
  • Interest rates and fee structures
  • Credit approval processes
  • Complaints and dispute resolution procedures

4. Eligibility Requirements

To use our services and apply for credit through our platform, you must meet the following minimum requirements:

  • Be at least 18 years of age
  • Be a South African citizen or hold permanent residency status
  • Possess a valid South African identity document or passport
  • Have a regular and verifiable source of income
  • Maintain an active South African bank account in your own name
  • Have a valid South African mobile phone number and email address
  • Not be under debt review, administration, or sequestration
  • Not be an unrehabilitated insolvent
  • Have the legal capacity to enter into a credit agreement

By submitting an application, you warrant that you meet all eligibility requirements. Credit providers may have additional eligibility criteria beyond these minimum requirements.

5. Application Process and Your Authorizations

5.1 Submission of Information

When you submit a loan application through our platform, you provide us with personal and financial information. By submitting this information, you expressly authorize and consent to LoanHunters to:

  • Collect, process, and store your personal information as detailed in our Privacy Policy
  • Share your complete application information with one or more registered credit providers
  • Facilitate communication between you and credit providers regarding your application
  • Retain your information in our database for future potential credit matching opportunities
  • Contact you regarding your application status and future credit opportunities

5.2 Credit Checks and Verification

By submitting an application, you specifically authorize credit providers to:

  • Conduct credit checks and obtain your credit report from registered credit bureaus
  • Verify your identity, employment, and income information
  • Verify your banking details and account status
  • Contact your employer or other references if necessary
  • Perform fraud checks and verify information with relevant authorities
  • Record details of your application on your credit profile, whether approved or declined

Important: Each credit inquiry may appear on your credit report. Multiple applications may impact your credit score.

5.3 Processing Timeline

Once submitted, your application will be forwarded to appropriate credit providers typically within 24-48 business hours. Credit providers will assess your application based on their own criteria and timelines. We do not control or influence the processing time or outcome of your application.

5.4 No Guaranteed Approval

Submission of an application does NOT guarantee credit approval. LoanHunters does not guarantee:

  • That your application will be approved by any credit provider
  • The amount, terms, or interest rate you may be offered
  • The timeframe for receiving an offer or decision
  • That any specific credit provider will consider your application

6. Fees and Costs

6.1 No Consumer Fees

LoanHunters does NOT charge consumers any fees for using our intermediary services. Our services are completely free to applicants. We earn commission from credit providers only after successful loan disbursements.

6.2 Credit Provider Fees

Credit providers may charge various fees including but not limited to:

  • Initiation fees
  • Monthly service fees
  • Interest charges
  • Credit life insurance premiums
  • Late payment fees
  • Collection costs

All fees charged by credit providers must be disclosed to you in a pre-agreement statement and quotation before you accept any credit offer. You are encouraged to carefully review all fees and costs before accepting any credit agreement.

6.3 Fee Limitations

All fees charged by credit providers are subject to maximum limits prescribed by the National Credit Act and regulations. No credit provider may charge fees exceeding these prescribed limits.

7. Your Obligations and Warranties

7.1 Accuracy of Information

You warrant that all information provided in your application is:

  • True, accurate, complete, and current
  • Not misleading or fraudulent in any way
  • Provided voluntarily with your full knowledge and consent

You agree to update any information that changes during the application process. Providing false, misleading, or fraudulent information may result in:

  • Immediate rejection of your application
  • Termination of any approved credit agreements
  • Reporting to credit bureaus and fraud detection services
  • Civil or criminal legal action
  • Permanent exclusion from using our services

7.2 Responsible Borrowing

You acknowledge your responsibility to borrow responsibly and agree that you will:

  • Only apply for credit you genuinely need and can afford to repay
  • Carefully consider your financial situation before accepting any credit offer
  • Review all terms, conditions, and costs before accepting credit
  • Understand the consequences of defaulting on credit obligations
  • Seek financial counseling if you are uncertain about credit obligations

7.3 Communication Obligations

You agree to:

  • Provide accurate contact information and keep it updated
  • Respond promptly to requests for additional information or documentation
  • Review communications from us and credit providers carefully
  • Notify us immediately of any unauthorized use of your information

8. Responsible Lending and Consumer Protection

8.1 Pre-Application Considerations

Before applying for credit, you should carefully consider:

  • Whether you genuinely need the credit or if alternatives exist
  • Whether you can afford the monthly repayments from your regular income
  • The total cost of credit including all interest and fees
  • The loan term and total amount you will repay
  • How the repayments will affect your monthly budget and existing obligations
  • The consequences of missing payments or defaulting
  • Whether you have existing debt that should be addressed first

8.2 Warnings and Cautionary Statements

Important Consumer Warnings:

  • Credit costs money - ensure you can afford repayments before borrowing
  • Failure to repay credit will negatively impact your credit record and may result in legal action
  • Your property or assets may be at risk if you do not maintain repayments
  • Consolidating debt does not reduce what you owe; it may extend repayment periods and increase costs
  • Borrowing to repay existing debt often worsens financial problems
  • If you are experiencing financial difficulty, seek debt counseling rather than additional credit

8.3 Right to Financial Counseling

You have the right to seek free or affordable financial counseling at any time. We recommend consulting with a financial advisor or debt counselor if you:

  • Are unsure whether you can afford the credit
  • Are experiencing financial difficulty
  • Have multiple existing credit obligations
  • Are considering debt consolidation

8.4 Affordability Assessments

All credit providers are legally required to conduct affordability assessments before approving credit. An affordability assessment evaluates whether you can afford the credit without becoming over-indebted. Credit providers will consider your:

  • Monthly income and its regularity
  • Monthly financial obligations and expenses
  • Existing debt obligations
  • Credit history and repayment behavior

9. Your Rights as a Consumer

9.1 Right to Information

You have the right to:

  • Receive clear information about credit products and their costs
  • Receive a pre-agreement statement and quotation before accepting credit
  • Understand all terms and conditions before entering a credit agreement
  • Request clarification about any aspect of a credit offer
  • Receive copies of all signed agreements and documentation

9.2 Right to Fair Credit Practices

You have the right to:

  • Be treated fairly and without discrimination
  • Have your application assessed based on objective criteria
  • Not be charged fees exceeding prescribed limits
  • Not be subjected to reckless lending practices
  • Receive reasons if your application is declined

9.3 Cooling-Off Period

If you accept a credit offer, you have a cooling-off period during which you may terminate the credit agreement without reason or penalty. The cooling-off period is:

  • 5 business days for unsecured credit agreements
  • 7 business days for secured credit agreements

To exercise your cooling-off rights, you must provide written notice to the credit provider and return any money or goods received. Specific procedures are outlined in your credit agreement.

9.4 Right to Privacy

Your personal information is protected under POPIA. You have rights regarding your personal information as detailed in our Privacy Policy, including rights to access, correct, and delete your information under certain circumstances.

10. Data Protection and Privacy

The collection, use, and protection of your personal information is governed by our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA). By using our services, you consent to the processing of your personal information as described in our Privacy Policy.

11. Intellectual Property Rights

All content on the LoanHunters website, including but not limited to text, graphics, logos, images, software, and design elements, is the intellectual property of LoanHunters or its licensors and is protected by South African and international copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or modify any content from our website without written permission
  • Use our trademarks, logos, or branding without authorization
  • Create derivative works based on our content
  • Use automated systems or software to extract data from our website
  • Frame or mirror any content from our website

12. Disclaimers and Limitations

12.1 Service Availability

Our services are provided on an "as is" and "as available" basis. We do not warrant that:

  • Our services will be uninterrupted, timely, secure, or error-free

  • Any defects or errors will be corrected

12.2 No Warranties Regarding Credit

LoanHunters makes no warranties, representations, or guarantees that:

  • Your application will be approved by any credit provider
  • You will receive any specific loan amount, rate, or terms
  • Any credit provider will respond to your application within a specific timeframe
  • The information provided about credit products is complete or current

12.3 Third-Party Actions

We are not responsible for the actions, decisions, terms, or conduct of credit providers or other third parties. Each credit provider is an independent entity responsible for their own business practices, credit decisions, and compliance with applicable laws.

13. Limitation of Liability

To the maximum extent permitted by law, LoanHunters shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to:

  • Your use of or inability to use our services
  • Denial of credit or inability to obtain a loan
  • Credit terms, rates, or conditions offered by credit providers
  • Actions or omissions of credit providers or other third parties
  • Unauthorized access to or alteration of your information
  • Errors or omissions in any content or information
  • Any credit agreement entered into with a credit provider
  • Loss of data, profits, or business opportunities

This limitation applies regardless of the legal theory upon which liability is based, whether contract, tort, negligence, strict liability, or otherwise.

14. Indemnification

You agree to indemnify, defend, and hold harmless LoanHunters, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:

  • Your use of our services
  • Your violation of these Terms and Conditions
  • Your violation of any applicable laws or regulations
  • Your provision of false, misleading, or fraudulent information
  • Your violation of any third-party rights
  • Any credit agreement you enter into with a credit provider

15. Complaints and Dispute Resolution

We will acknowledge your complaint within 5 business days and endeavor to resolve it within 20 business days. If we cannot resolve your complaint to your satisfaction, we will inform you of your right to escalate the matter.

For complaints regarding a credit provider's services, credit decisions, or credit agreements, you should first contact the credit provider directly using their complaints procedure. If unresolved, you may escalate to the relevant ombud or the NCR.

16. Termination and Suspension

16.1 Your Right to Terminate

You may cease using our services at any time. To request removal of your information from our database, contact us at privacy@loanhunters.co.za. Note that we may be required to retain certain information for legal or regulatory purposes.

16.2 Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your access to our services immediately, without notice, if we reasonably believe you have:

  • Violated these Terms and Conditions
  • Provided false, misleading, or fraudulent information
  • Engaged in fraudulent or illegal activities
  • Misused our services or website
  • Harassed or abused our staff or credit providers

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa, including but not limited to:

  • The National Credit Act, 2005 (Act No. 34 of 2005)
  • The Protection of Personal Information Act, 2013 (Act No. 4 of 2013)
  • The Consumer Protection Act, 2008 (Act No. 68 of 2008)
  • The Electronic Communications and Transactions Act, 2002 (Act No. 25 of 2002)

Any disputes arising from these Terms and Conditions or your use of our services shall be subject to the non-exclusive jurisdiction of the courts of the Republic of South Africa.

18. Changes to Terms and Conditions

We reserve the right to modify, amend, or update these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Material changes will be notified to users via:

19.5 Language

These Terms and Conditions are drafted in English. If translated into other languages, the English version shall prevail in case of any inconsistency or dispute.
